TOWNSEND MAN SENTENCED FOR PROBATION VIOLATION

(Wilmington, DE) – Patrick T. Carter, Director of Revenue announced today that a Townsend resident returned to New Castle County Superior Court to face charges of violation of probation following an earlier conviction on tax charges.

Phillip A. Dye, 58, appeared before NCC Judge Jerome O. Herlihy and was found to be in violation of his probation. Dye was convicted by a jury on May 31, 2002 on two felony counts of tax evasion as well as three misdemeanor counts of failing to file Delaware personal income tax returns following an investigation by the Division of Revenue’s Criminal Investigation Unit.

Herlihy originally sentenced Dye to 7 years probation but revoked his probation for failing to comply with the terms and sentenced him to 30 days in the Violation of Probation Center.

Dye had been on probation since July 2002 after being found guilty of the tax charges. As a condition of probation, Dye was ordered to file proper income tax returns with the Delaware Division of Revenue. Instead, Dye submitted fraudulent income tax returns to the Division of Revenue requesting unlawful refunds.

This case was prosecuted by the Delaware Attorney General’s office.
