Delaware has a new deduction available for Active Labor Organization

• Dues worth the minimum of either $500 or the actual amount paid. The deduction is available on line 16 of the Delaware Resident return to the extent the dues have not already been included on your federal return, or the dues are used by the union to cover benefits such as health insurance, retirement plans, lobby or engage in political activities or pay for legal cost or fines.

Ordinary and Normal Business Expense Deductions for Marijuana Establishments on Business Income Tax Returns

• Effective August 1, 2023, The Delaware Marijuana Control Act (House Bill 2 during the 152nd General Assembly) allows a state deduction from federal taxable income for the ordinary and necessary business expenses incurred by a marijuana establishment as otherwise disallowed as a deduction for federal tax purposes.
  • Please note that should a federal deduction for ordinary and necessary business expenses related to a marijuana establishment become available, the additional Delaware deduction will no longer be permitted as the deduction would already have been incorporated into federal adjusted gross income.

Business Tax

In Delaware, due dates for Delaware business income tax returns follow the due dates for federal business income tax returns, as follows:

• Partnership returns are due on or before March 17, 2025 for calendar year taxpayers.
• S corporation returns are due on or before March 17, 2025 for calendar year taxpayers.
• Returns for C corporations are generally due on or before April 15, 2025 for calendar year taxpayers.
