• 2016 State of Delaware Personal Income Tax is due May 1, 2017.

• Delaware will begin releasing refunds starting in mid-February, allowing the Division of Revenue more time to detect and prevent fraud. This will ensure that all taxpayers get the refund they are owed.

• Many state revenue agencies, including Delaware, are requesting additional information this filing season in an effort to combat stolen-identity tax fraud and to protect you and your tax return on returns filed online using the IRS E-File Tax System. If you and your spouse have a driver's license or state issued identification card, please provide the requested information from it. The return will not be rejected if you do not provide a driver's license or state-issued identification, but it will assist us to properly identify the taxpayer and ensure faster tax return processing.

New Business Tax Return Due Dates for Partnerships and Corporations

  • The Internal Revenue Code now requires that:
    • Partnership returns are due on or before the 15th day of the third month following the expiration of the taxable period (March 15 for calendar year taxpayers)
    • Returns for all other business organizations, including corporations, are due on or before the 15th day of the fourth month following the expiration of the taxable period (April 15 for calendar year taxpayers)
  • Delaware will be enacting legislation early in 2017 to adopt the same due dates for Delaware’s business tax returns, effective immediately
  • Delaware’s due dates for the 2016 tax year will now be consistent with the federal due dates

  • If you are concerned about penalties imposed for filing a 2016 partnership return after the new deadline, protests of such penalties should be submitted to the Director of Revenue, who will liberally grant penalty abatement if the late filing resulted from the late change to the deadline
